Welcome to Bugnet. These Terms of Service ("Terms") govern your access to and use of the Bugnet platform, website, and related services (collectively, the "Service"). Please read these Terms carefully before using Bugnet.
1. Acceptance of Terms
By creating an account, accessing, or using Bugnet, you agree to be bound by these Terms and our Privacy Policy. If you are using Bugnet on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and "you" refers to both you individually and that organization.
If you do not agree to these Terms, you may not use the Service.
2. Description of Service
Bugnet is a bug-tracking and project management platform designed specifically for indie game developers. The Service allows you to:
- Create and manage bug reports, feature requests, and tasks for your game projects
- Capture and organize screenshots, crash logs, and other debugging data
- Collaborate with team members on identifying and resolving issues
- Integrate with third-party tools and platforms, including Steam
- Track project progress through dashboards and reporting tools
We may add, modify, or discontinue features of the Service at any time. We will provide reasonable notice before removing features that you actively rely on.
Bugnet is a tool that helps you capture, organize, and track issues. It is not a substitute for your own quality assurance and testing, and we do not guarantee that the Service will detect, capture, reproduce, or report every bug, crash, error, or issue in your game or application.
3. Account Registration
To use Bugnet, you must create an account. When registering, you agree to:
- Provide accurate, current, and complete information
- Keep your account credentials secure and confidential
- Notify us immediately if you suspect unauthorized access to your account
- Be responsible for all activity that occurs under your account
You must be at least 16 years old to create an account. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.
We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period, with prior notice.
4. Acceptable Use
You agree to use Bugnet responsibly and in compliance with all applicable laws. You may not:
- Use the Service for any illegal or unauthorized purpose
- Upload or transmit malware, viruses, or other harmful code
- Attempt to gain unauthorized access to our systems, other users' accounts, or data
- Interfere with or disrupt the Service, servers, or networks connected to the Service
- Scrape, crawl, or use automated tools to extract data from the Service without our written permission
- Impersonate another person or entity
- Use the Service to harass, abuse, or harm others
- Share content that is defamatory, obscene, or infringes on the rights of others
- Resell, sublicense, or redistribute access to the Service without authorization
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service, except where this restriction is prohibited by applicable law
- Use the Service to build, train, or benchmark a competing product or service
- Publish or disclose any performance or benchmark results relating to the Service without our prior written consent
- Remove, obscure, or alter any proprietary notices, labels, or marks on or within the Service
We reserve the right to investigate and take appropriate action against any violations, including suspending or terminating your account.
5. Content Standards and Restrictions
Bugnet is a bug-tracking tool intended for the development of games and software. You are solely responsible for all content you or your players upload, submit, capture, transmit, or store through the Service, including bug reports, screenshots, video and audio recordings, session replays, crash logs, code snippets, file attachments, and any associated metadata (collectively, "User Content").
No adult or mature content. You may not use the Service in connection with, and you may not upload or transmit any User Content relating to or derived from, any game, application, or product that contains adult or mature themes. This includes, without limitation, any game or content that:
- Is pornographic, sexually explicit, or contains nudity or sexual content;
- Depicts or describes sexual acts, sexual violence, or other sexually suggestive material;
- Is rated "Adults Only" (AO) by the ESRB, PEGI 18, or carries an equivalent adult or 18+ rating under any other rating system, or would qualify for such a rating;
- Contains gratuitous, extreme, or glorified violence, gore, or cruelty;
- Promotes, facilitates, or depicts the sexual exploitation or abuse of minors;
- Promotes hate, harassment, discrimination, terrorism, self-harm, or illegal activity; or
- Is otherwise obscene, indecent, or unlawful in the jurisdictions in which it is distributed.
You further agree that your User Content will not infringe, misappropriate, or violate the intellectual property, privacy, publicity, or other rights of any third party, and that you have obtained all rights, consents, and permissions necessary to upload it and to grant the license described in Section 6.
We do not pre-screen User Content, and we are under no obligation to monitor it. However, we reserve the right, in our sole discretion and without notice, to review, refuse, remove, restrict access to, or disable any User Content, and to suspend or terminate any account, that we believe violates these Terms or applicable law, or that we otherwise find objectionable. You acknowledge that you bear all risks associated with your User Content and that Bugnet assumes no responsibility or liability for User Content, as further described in Section 6 and Section 12.
6. Intellectual Property and User Content
Your Content: You retain full ownership of all User Content you upload, submit, or create through Bugnet. By using the Service, you grant Bugnet a limited, non-exclusive, worldwide, royalty-free license to host, store, copy, process, transmit, and display Your Content solely to the extent necessary to operate and provide the Service to you and to comply with applicable law. We claim no ownership over Your Content.
Your responsibility and our disclaimer. You are solely responsible for your User Content and for the consequences of uploading, storing, transmitting, or sharing it. You represent and warrant that you own or have all necessary rights to your User Content and that it complies with these Terms, including Section 5. To the maximum extent permitted by law, Bugnet acts only as a passive conduit and storage provider for User Content and has no liability whatsoever, to you or to any third party, arising out of or relating to User Content — including its legality, accuracy, quality, or any loss, deletion, or unauthorized access to it, or any claim that it infringes the rights of, or has caused harm to, a third party. We do not endorse and are not responsible for any User Content, and any reliance on it is at your own risk.
Our Platform: Bugnet and its original content, features, and functionality (excluding User Content) are owned by Bugnet and are protected by copyright, trademark, and other intellectual property laws. The Bugnet name, logo, and all related marks are trademarks of Bugnet. You may not use our branding without prior written permission.
Feedback: If you provide us with suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free license to use that feedback to improve our platform without any obligation to you.
7. Copyright Complaints (DMCA)
We respect the intellectual property rights of others and expect our users to do the same. If you believe that content on the Service infringes your copyright, please send a notice to legal@bugnet.io that includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to have been infringed; (c) identification of the material that is claimed to be infringing and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief that the use is not authorized; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We may remove allegedly infringing content and terminate the accounts of repeat infringers.
8. Data and Privacy
Your privacy matters to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using Bugnet, you agree to the data practices described in our Privacy Policy.
You are responsible for any personal data you upload to Bugnet, including ensuring you have the right to share that data. If your bug reports or projects contain personal data from your users or players, you are responsible for complying with applicable data protection laws.
9. Third-Party Services and Integrations
The Service relies on and lets you connect to third-party platforms and services, including Steam (Valve), Firebase (Google), Discord, Stripe, Backblaze B2, and Git providers. These third parties are not controlled by us, and their availability, security, performance, and handling of data are governed by their own terms and policies, not these Terms.
Your use of any integration is at your own risk and is subject to your agreement with the relevant provider. To the maximum extent permitted by law, Bugnet is not responsible or liable for the acts, omissions, changes, outages, or data practices of any third-party platform, or for any loss arising from your use of, or inability to use, such platforms. We may suspend, limit, or remove any integration at any time, including where a third party changes or discontinues its services.
10. Payment Terms
Free Tier: Bugnet offers a free tier with limited features and usage. The free tier is provided as-is and may be modified at any time. We will notify existing free-tier users of any significant changes.
Paid Plans: Paid subscriptions are billed on a monthly or annual basis, depending on the plan you select. Prices are listed on our pricing page and are subject to change with 30 days' notice. You authorize us to charge your payment method on a recurring basis until you cancel.
Upgrades and Downgrades: You may upgrade or downgrade your plan at any time through your account settings. Upgrades take effect immediately, and you will be charged a prorated amount for the remainder of your billing cycle. Downgrades take effect at the start of your next billing cycle.
Refunds: If you are unsatisfied with a paid plan, you may request a refund within 14 days of your initial purchase or renewal. Refund requests should be sent to legal@bugnet.io. Refunds are issued at our discretion and are not guaranteed for partial billing periods or after the 14-day window.
Taxes: Prices do not include applicable taxes. You are responsible for any taxes, duties, or levies imposed by your jurisdiction.
11. Beta and No-Charge Features
We may offer features, products, or services that are identified as beta, preview, early access, experimental, or otherwise provided free of charge (collectively, "Beta and No-Charge Features"). These features may be incomplete, may change at any time, may never be made generally available, and may be modified or discontinued without notice.
Beta and No-Charge Features are provided "as is" and "as available," with no warranty, no service-level commitment, and no support obligation of any kind. Notwithstanding any other provision of these Terms, our total aggregate liability arising out of or relating to any Beta and No-Charge Feature shall not exceed US $50.
12. Limitation of Liability
To the maximum extent permitted by law, Bugnet and its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Service, or arising from any User Content.
Without limiting the foregoing, and as described in Section 5 and Section 6, Bugnet shall have no liability of any kind for User Content or for any content uploaded, submitted, stored, transmitted, shared, or made available through the Service by you, your team members, or your players, including any claim relating to its legality, accuracy, reliability, or infringement of third-party rights, or any loss of or unauthorized access to such content.
Our total aggregate liability for any claims arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 USD, whichever is greater.
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any User Content will be preserved without loss. We further do not warrant that the Service will identify, capture, reproduce, or report all bugs, crashes, errors, or other issues in your game or application, that any captured data will be complete or accurate, or that any issue will be surfaced in time to prevent loss or harm.
13. Indemnification
You agree to defend, indemnify, and hold harmless Bugnet and its founders, employees, contractors, and affiliates from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or related to: (a) your User Content; (b) your use of the Service; (c) your violation of these Terms, including Section 5; (d) your violation of any applicable law or the rights of any third party; or (e) any game, application, or product you develop, distribute, or operate in connection with the Service. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with us.
14. Suspension of Service
Separate from termination, we may suspend, throttle, or restrict your access to all or part of the Service, with or without notice, if:
- Your fees are overdue (for example, 30 or more days past due)
- We reasonably believe there is a security risk, suspected compromise, or fraudulent activity associated with your account
- You violate these Terms, including the Acceptable Use or Content Standards and Restrictions sections
- Your usage places excessive load on the Service or exceeds applicable rate limits
- Suspension is required to comply with applicable law or a request from a governmental or regulatory authority
Where practical, we will restore access once the underlying cause has been resolved. Suspension does not relieve you of your obligation to pay fees accrued before or during the suspension.
15. Termination
You may close your account at any time through your account settings or by contacting us at legal@bugnet.io. Upon account closure:
- Your access to the Service will end immediately
- We will retain your data for 30 days in case you change your mind, after which it will be permanently deleted
- Any prepaid fees for unused portions of your subscription will not be refunded, unless the termination is initiated by us without cause
We may terminate your account if you violate these Terms, engage in fraudulent activity, or if required to do so by law (in addition to our suspension rights described in Section 14). We will provide notice and an opportunity to export your data whenever possible, unless immediate action is required to protect the Service or other users.
16. Publicity
We may identify you or your studio as a Bugnet customer and use your name and logo in our marketing materials and on our website, consistent with any brand guidelines you provide to us. If you prefer that we not do so, you may opt out at any time by emailing legal@bugnet.io.
17. Changes to Terms
We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a prominent notice on our website at least 14 days before the changes take effect.
Your continued use of Bugnet after the updated Terms become effective constitutes your acceptance of the changes. If you do not agree with the updated Terms, you must stop using the Service and close your account.
18. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in Delaware.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
